Based on the aforesaid contentions, the matter is referred to the Mediation & Conciliation Centre of this Court.

Accordingly, parties are directed to appear before the Mediation & Conciliation Centre of this Court on 15.02.2017."

In view of the above and in view of the fact that learned counsel for the appellant on 20.01.2017 had limited his argument only to the extant that the matter be referred to the Mediation and Conciliation Centre of this Court as also the fact that the mediation has since failed, nothing more survives in the present appeal, which is accordingly dismissed.
