For the reasons set out in the application, which is duly supported by an affidavit, the same is allowed. Consequently, the delay of 68 days in re-filing the accompanying appeal is condoned. CM-5458-CI-2017:

This is an application for condonation of delay of 201 days in filing the accompanying appeal. All what has been urged by learned counsel for the applicant/appellant is that the matter in issue is squarely covered by the order and judgment, dated 24.02.2016, rendered by this Court in RFA No. 3860 of 2014 (Ajmer Singh and others v. State of Haryana and others) and other connected matters, vide which, in the appeals arising out of the same acquisition, this Court had enhanced the compensation awarded to the landowners uniformly to Rs.3,610/- per sq. meter. Notice in the application.

Ms. Safia Gupta, AAG, Haryana, present in the Court, accepts notice on behalf of the respondents.

For, learned counsel for the parties are ad idem that the matter in issue is squarely covered by the decision rendered by this Court in Ajmer Singh's case (supra), the present appeal is disposed of in term of the said decision.
