HON'BLE MR. JUSTICE AMIT RAWAL
Present:
Mr. D.K. Tuteja, Advocate for the appellant.
**** AMIT RAWAL, J. (ORAL) The notice pertained to the civil suit or proceeding, in respect of the eviction of any person, who is in unauthorized occupation of any public premises is barred, as per the provisions of Section 15 of the Punjab Public Premises and Land (Eviction and Rent Recovery) Act, 1973, as applicable to the State of Punjab, even otherwise, the suit claiming ownership, on the basis of the adverse possession, in view of the law laid down by Hon'ble the Supreme Court in "Gurudwara Sahib V/s Gram Panchayat Village Sirthala and another" 2013 (4) RCR (Civil) 703, was not maintainable.
In this view of the matter, I do not find any illegality and perversity in the judgments and decrees of the Courts below, much less, no substantial question of law arises for determination. No ground for interference is made out.
Resultantly, the present regular second appeal is dismissed. 20.02.2019 Yogesh Sharma ( AMIT RAWAL ) JUDGE Whether speaking/reasoned Yes/ No Whether Reportable Yes/ No
