Tribhuvan Dahiya, J (Oral) This revision petition has been filed under Article 227 of the Constitution of India for setting aside order dated 07.09.2022 (Annexure P7), vide which the respondent-plaintiff's application seeking amendment of the plaint has been allowed.
Learned counsel for the petitioners contends that the application has been allowed at the belated stage when the case was fixed for final arguments.
A perusal of the impugned order passed by the trial Court, dated 07.09.2022, shows that the amendment has been allowed since it was only formal in nature and would not change the nature of the suit in question. It was only on account of inadvertence that certain words could not be mentioned in the body of the plaint by the respondent-plaintiff which were sought to be mentioned by filing the application for amendment. CR No.4798 of 2022 [2] Learned counsel for the petitioner has not been able to point out any prejudice that would be caused to the petitioners-defendants on account of the amendment having been allowed by the impugned order. Therefore, there is no ground to interfere with the order. Dismissed.
