Counsel for the applicant-appellant states that the application has become infructuous.

Dismissed as having been rendered infructuous. CM-1436-C-2025 3.

Application is allowed, as prayed for.

Compromise arrived at between the parties during the pendency of the appeal is taken on record as Annexure A-1. CM-1437-C-2025 IN/AND RSA-4083-2016 5.

Prayer in the application filed under Order 23 Rule 3 CPC is for disposing off the appeal in terms of the compromise deed dated 14.12.2024, Annexure A-1, arrived at between the parties.

Mr. Pandit submits that during the pendency of the appeal, parties have amicably settled the dispute and have reduced it into writing. He submits that the compromise, Annexure A-1, arrived at between the parties be made a part of the decree.

In terms of the compromise, Mr. Pandit has handed over a demand draft of Rs.4 lacs drawn in the name of Malkiat Singh to the counsel for the respondent. Xerox copy of the demand draft has been taken on record.

Notice of the application to the non-applicant/respondent. 9.

Mr. R.S.Dhillon, Advocate accepts notice on behalf of nonapplicant/respondent. He confirms the development and states that he does not have any objection in case the appeal is disposed off in terms of the compromise.

Accordingly, application is allowed.

Appeal is disposed off in terms of the compromise and compromise is ordered to be made part of the decree. CM-1438-C-2025 12.

In view of the order dated 11.03.2025 passed by this Court in RSA-2515-2019 titled as "Om Pal Versus Ashok Kumar", Mr. Pandit, in all fairness, seeks and is granted permission to withdraw the application. 13.

Dismissed as withdrawn.

For the reasons given in the application, it is allowed. 15.

Order dated 13.02.2025, Annexure R-1, is ordered to be corrected and shall be read as follows:-
