The petitioner has approached this Court by way of instant writ petition under Article 226 of the Constitution of India praying for issuance of a writ in the nature of mandamus, directing the respondents to allow the petitioner to participate in the physical screening test and physical measurement test/scrutiny of documents against the posts remained vacant on account of disqualification or due to the reason that some of selected candidates did not appear for counselling and biometric verification, in pursuance of advertisement No.3/2021 dated 15.06.2021 published for filling up posts of Sub-Inspector (Male) under BCA (DNT) (Vimukt Jaati - Denotified Tribe). In this regard, petitioner has lastly submitted a PANKAJ KUMAR 2022.04.08 17:01 I attest to the accuracy and authenticity of this document

CWP No.26646 of 2021 (O&M) -2representation dated 15.12.2021 (Annexure P-22) requesting official respondents to re-conduct the physical measurement test of the petitioner, however, no action has been taken thereon.

Counsel for the petitioner would submit that the petitioner would be satisfied if the representation dated 15.12.2021 (Annexure P-22) is considered and decided by official respondents in a time bound manner. 3.

Ms. Kirti Singh, DAG, Haryana, who is present in Court, accepts notice for respondents and submits that respondents will look into the matter and take a decision in accordance with law. Let sufficient number of copies of the complete paper book be supplied to the counsel appearing for the respondents during the course of day. 5.

Without commenting on merits of the case, I dispose of the instant petition by directing the respondents to consider the representation dated 15.12.2021 (Annexure P-22) submitted by the petitioner and take a decision thereon within a period of two months from the date of receipt of certified copy of this order and convey the decision to the petitioner, failing which the officer responsible for the lapse would be liable to deposit costs of Rs.20,000/- from his personal pocket with the Punjab and Haryana High Court Advocates Welfare Fund.
