+*, -  *$.& The applicant submits that respondent-SICCL. in exercise of clause-23 of the arbitration agreement has appointed an arbitrator. It is submitted that the applicant feels that the arbitrator is not impartial and he is not picked to be appointed as an arbitrator.

Being aggrieved, the applicant has filed this application under section 11 of the Arbitration and Conciliation Act, 1996. Apparently, after appointment of the arbitrator by the respondent-SICCL who is empowered to do so under clause 23 of the arbitration agreement, the issues raised by the applicant cannot be taken up under section 11 of the Act. The application is accordingly dismissed with liberty to the applicant to take up his grievance and issues before the appropriate forum at appropriate stage in accordance with law.
