By this judgment, this Bench shall dispose of a bunch of the regular first appeals/cross-appeals (details whereof are available at the foot

of the judgment) filed against the various judgments passed by the Additional District Judge, Rewari (hereinafter referred to as "the Reference Court") with respect to the acquisition of the land measuring 1016 acres 1 kanal and 3 marlas (8129 kanals 3 marlas) located in the villages Suthani, Jaliawas, Suthana, Karnawas, Chirhara, Asalwas, Banipur, Patuhera and Bawalpur Jaliawas, Asalwas, Suthani, Suthana, Karnawas, Chirhara, Banipur, Bawal and Patuhera by a common notification dated 02.12.2005 under Section 4 of the Land Acquisition Act, 1894 (hereinafter referred to as "the 1894 Act"). The facts of the case are being taken from the Regular Second Appeal No. 1436 of 2018 arising from award No. 16/R dated 25.05.2006.

On 02.12.2005, the State of Haryana issued a notification under Section 4 of the he 1894 Act proposing to acquire the land in the aforesaid villages for extension of the Industrial Growth Centre, Bawal, to be structured as Industrial Recreation and Other Public Utility Centre. The Land Acquisition Collector (hereinafter referred to as "the LAC") announced the various awards village-wise, details whereof are compiled as under: I) Village Suthani - Award No. 8/R dated 17.05.2006. The total acquisition of the land is 1285 kanals and 2 marlas, acquired as Chahi (1114K-18M), Banjar Qadim (125K4M) and Gairmumkin (45K). II) Village Jaliawas - Award No.9/R dated 17.05.2006. The total acquisition of the land is 325 kanals and 4 marlas, acquired as Chahi (296K-02M), Barani (17K-12M) and Gairmumkin (11 k).

III) Village Suthana - Award No. 10/R dated 23.05.2006. The total acquisition of the land is 27 kanals and 13 marlas (Chahi).

IV) Village Karnawas - Award No. 11/R dated 23.05.2006. The total acquisition of the land is 778 kanals and 13 marlas, acquired as Chahi (437 K), Bhud (128K-02M), Banjar (148K-17M), Mugda (13K-6M) and Gairmumkin (14K-18M).

V) Village Chirhara - Award No. 12/R dated 25.05.2006. The total acquisition of the land is 112 kanals and 9 marlas, acquired as Chahi (90K-6M), Barani (9K-6M) and Gairmumkin (12K-17M).

VI) Village Asalwas - Award No. 13/R dated 25.05.2006. The total acquisition of the land is 1562 kanals and 11 marlas, acquired as Chahi (1308K-4M), Barani (226K-8M) and Gairmumkin (27K-19M).

VII) Village Banipur - Award No. 14/R dated 25.05.2006. The total acquisition of the land is 1543 kanals and 14 marlas, acquired as Chahi (1478K-19M), Barani (17K-02 M) and Gairmumkin (55K-12M).

VIII) Village Patuhera - Award No. 15/R dated 25.05.2006. The total acquisition of the land is 1934 kanals and 13 marlas, acquired as Chahi (1643K-17M), Barani (259K11M) and Gairmumkin ( 31K- 05M). IX) Village Bawalpur - Award No. 16/R dated 25.05.2006.

The total acquisition of the land is 550 kanals and 12 marlas, acquired as Chahi (529K-13M) and Gairmumkin ( 20K- 19M).

FACTS 2.1 The LAC through the aforesaid various awards uniformly assessed the market value of the land @ 12,50,000/- per acre. The owners ₹ were also held entitled to the amended provisions of the 1894 Act including the additional amount and solatium @ 30%. On their applications, the LAC referred the matter to the Court for determination of the market value of the land under Section 18 of the 1894 Act.

2.2 In the first round, on 26.02.2015, the Reference Court assessed the market value of the land @ 16,00,000/- per acre. However, on ₹ 07.04.2007, in the appeals, filed by the owners as well as the beneficiary of the acquisition i.e. Haryana State Industrial and Infrastructure Development Corporation (hereinafter referred to as "the HSIIDC"), the cases were remitted back to the Reference Court for a fresh decision. The main judgment is in Haryana State Industrial Development Corporation (now Haryana State Industrial and Infrastructure Development Corporation Limited) v. Ashok Kumar and Others (Regular First Appeal No. 3619 of 2015). As directed by the High Court, the parties were permitted to lead further evidence and through the various separate judgments, the Reference Court has assessed a uniform market value of the acquired land @ 19,30,491/-.

₹ 2.3 At this stage, it is appropriate to notice that normally, 1 acre of land consists of 4840 square yards area. Each acre consists of 8 kanals of

land. In other words, 1 kanal of land is equivalent to 605 square yards. Each kanal of land consists of 20 marlas. Accordingly, 1 acre of land normally consists of 160 marlas of land. Each marla of land is a little bit more than 30 square yards area. The expression 'Chahi' means the land which has an irrigation facility and can be used for growing 2 crops in a year, whereas expression 'Barani' means the agricultural land which is dependent on rainfall for irrigation. Normally, in the later type of land only one crop can be sown depending upon the weather conditions. On the other hand, the expression 'Banjar' depicts land which is lying barren. The expression 'Gair Mumkin' is used by the revenue officials to describe a land which is used for non agricultural purposes.

2.4 Heard learned counsel representing the parties and with their able assistance, perused the paper book as well as the record of the Reference Court, which was requisitioned.

EVIDENCE 3.1 At this stage, it is important to note that the Reference Court, while deciding all these matters by separate judgments dealing with individual cases, village wise, has awarded a uniform amount, i.e., ₹19,30,491/-. On a careful perusal of the evidence produced by both the parties, it is evident that most of the sale deeds produced in one case have been repeated in the others. Thus, this Bench has taken the liberty to compile the information of all the sale deeds produced by the landowners, while excluding the repetition, in the following table:-

The details of the sale deeds, produced by the HSIIDC, are compiled in a tabulated form, which reads as under:

In the proceedings before the Reference Court arising from the acquisition of the land of village Bawal, the land

owners have examined Ran Singh as PW.1, Jang Bahadur as PW.2, S.S.Lamba, Manager, HSIIDC, as PW.3, Kailash Chand, Registration Clerk in the office of the Sub Registrar, Bawal, as PW.4, Suresh Chand as PW.5 and Mahabir Yadav, Civil Draftsman, as PW.6.

PW.1 Ran Singh and PW.2 Jang Bahadur have filed identical affidavits explaining the location of the acquired land. They have highlighted that the HSIIDC has sold a hotel site @ 3,250/- per square meter. PW.3 S.S.Lamba, Manager, ₹ HSIIDC, has also brought the allotment letter of the hotel site. PW.4 Kailash Chand, Registration Clerk, has proved the copies of the sale deeds. PW.5 Suresh Chand is also one of the owners of the agricultural land. PW.6 Mahabir Yadav has produced and proved the layout plan.On the other hand, the respondent-HSIIDC has examined Rajiv Kumar, Computer Operator-cum-Clerk, in the office of the LAC-cum-SDO(Civil), Rewari, as RW.1. He has produced and proved the notification under Section 4 and 6 of the 1894 Act and the award passed by the Land Acquisition Collector.

Ashok Kumar, an official of the HSIIDC, has been examined as RW.2, who admitted that in the years 1992, 1995, 2005 and 2008, the industrial model township was developed in the villages, namely Chilhana, Suthana, Suthani, Jaliawas, Asalwas, Banipur, Jalalpur, Rudh and Patuhera. Sunil, Registration Clerk, Tehsil Bawal, has appeared as RW.

In the proceedings before the Reference Court arising from the acquisition of the land of village Suthani, the land owners have examined Ram Singh, Lambardar, as PW.1, Subhash as PW.2, Abhey Singh, Legal Assistant, HSIIDC, Bawal, as PW.3, Om Parkash, Registration Clerk in the office of the Sub Registrar, Bawal, as PW.4, Kailash Chand, Registration Clerk in the office of the Sub Registrar, Bawal, as PW.5, Rakesh Kumar, Patwari Halqa Karnawas, as PW.6, Kuldeep, Patwari Halqa Sulkha, as PW.7 and Rajender Singh, Patwari in the office of the DRO-cum-LAC, Rewari, as PW.8. On the other hand, the same witnesses have been examined by the respondent-HSIIDC as noticed in the reference petition arising from the village Bawal.

In the proceedings before the Reference Court arising from the acquisition of the land of village Chirhara, the land owners have examined Jaswant Kumar as PW.1, Bhoom Singh as PW.2, Kuldeep, Patwari Halqa Sulkha, as PW.3, Abhey Singh, Legal Assistant, HSIIDC, Bawal, as PW.4, Sunil Kumar, Ahlmad to SDO(Civil)-cum-LAC, Rewari, as PW.7 and Rajender Singh, Patwari in the office of the DRO-cum-LAC, Rewari, as PW.8.

On the other hand, the same witnesses have been examined by the respondent-HSIIDC as noticed in the reference petition arising from the village Bawal.

In the proceedings before the Reference Court arising from the acquisition of the land of village Patuhera, the land owners have examined Gordhan as PW.1, Karan Singh as PW.2, Rakesh Kumar, Patwari Halqa Karnawas, as PW.3, Ram Kumar, Patwari Halqa Banipur, as PW.4, S.S.Lamba, Manager, HSIIDC, as PW.5, Sunil Kumar, Ahlmad to SDO(Civil)-cumLAC, Rewari, as PW.7 and Rajender Singh, Patwari in the office of the DRO-cum-LAC, Rewari, as PW.8.

On the other hand, the respondent-HSIIDC has examined Ashok Kumar, an official of the HSIIDC, as RW.1 and Jitender Kumar, Clerk in the office of the SDM, Bawal, as RW.2. 5.

In the proceedings before the Reference Court arising from the acquisition of the land of village Karnawas, the land owners have examined Som Dutt as PW.1, Soba Ram as PW.2, Abhey Singh, Legal Assistant, HSIIDC, Bawal, as PW.3, Om Parkash, Registration Clerk in the office of the Sub Registrar, Bawal, as PW.4, Rakesh Kumar, Patwari Halqa Karnawas, as PW.5, Mahabir Yadav, Civil Draftsman, as PW.6, Sunil Kumar, Ahlmad to SDO(Civil)-cum-LAC, Rewari, as PW.7 and Rajender Singh, Patwari in the office of the DRO-cum-LAC, Rewari, as PW.8.

On the other hand, the respondent-HSIIDC has examined Rajiv Kumar, Computer Operator-cum-Clerk, in the office of the LAC-cum-SDO(Civil), Rewari, as RW.1, Ashok Kumar, an official of the HSIIDC, as RW.2, Sunil, Registration clerk,

Tehsil Bawal, as RW.3 and Narender Kumar, Assistant Registration Clerk, Tehsil Rewari, as RW.4.

In the proceedings before the Reference Court arising from the acquisition of the land of village Banipur, the land owners have examined Ramphal as PW.1, Ram Singh as PW.2, Santosh Anand, Patwari Circle Bawal, as PW.3, Kailash Chand, Registry Clerk in the office of the Sub Registrar, Bawal, as PW.5, Sunil Kumar, Ahlmad to SDO(Civil)-cum-LAC, Rewari, as PW.7 and Rajender Singh, Patwari in the office of the DROcum-LAC, Rewari, as PW.8. On the other hand, the respondent-HSIIDC has examined Rajiv Kumar, Computer Operator-cum-Clerk, in the office of the LAC-cum-SDO(Civil), Rewari, as RW.1, Om Parkash, Clerk, HRC Branch in the office of Deputy Commissioner, Rewari, as RW.2, Ashok Kumar, an official of the HSIIDC, as RW.3 and Jitender Kumar, Clerk in the office of the SDM, Bawal, as RW.4.

In the proceedings before the Reference Court arising from the acquisition of the land of village Asalwas, the land owners have examined Banwari as PW.1, Ramphal as PW.2, Rakesh Kumar, Patwari Halqa Karnawas, as PW.3, Ram Kumar, Patwari Halqa Banipur, as PW.4, S.S.Lamba, Manager, HSIIDC, as PW.5, Jitender Kumar, Assistant Registration Clerk, Bawal, as PW.6, Sunil Kumar, Ahlmad to SDO(Civil)-cumLAC, Rewari, as PW.7 and Rajender Singh, Patwari in the

office of the DRO-cum-LAC, Rewari, as PW.8.

On the other hand, the respondent-HSIIDC has examined Rajiv Kumar, Computer Operator-cum-Clerk, in the office of the LAC-cum-SDO(Civil), Rewari, as RW.1, Om Parkash, Clerk, HRC Branch in the office of Deputy Commissioner, Rewari, as RW.2, Ashok Kumar, an official of the HSIIDC, as RW.3 and Jitender Kumar, Clerk in the office of the SDM, Bawal, as RW.4.

In the proceedings before the Reference Court arising from the acquisition of the land of village Jaliawas, the land owners have examined Dhan Singh as PW.1, Jaswant Singh as PW.2, Kuldeep, Patwari Halqa Sulkha, as PW.3, Abhey Singh, Legal Assistant, HSIIDC, Bawal, as PW.4, Kailash Chand, Registration Clerk in the office of the Sub Registrar, Bawal, as PW.5, Mahabir Yadav, Civil Draftsman, as PW.6, Sunil Kumar, Ahlmad to SDO(Civil)-cum-LAC, Rewari, as PW.7 and Rajender Singh, Patwari in the office of the DRO-cum-LAC, Rewari, as PW.8.

On the other hand, the respondent-HSIIDC has examined Ashok Kumar, an official of the HSIIDC, as RW.1 and Sunil, Registration Clerk, Tehsil Bawal, has appeared as RW2. 4.

ARGUMENTS OF THE LEARNED COUNSELS REPRESENTING THE PARTIES 4.1 The learned Senior counsel representing the HSIIDC submits that the Reference Court has committed a material error in relying upon the sale exemplars of tiny pieces of residential or commercial plots to determine the market value of the agricultural land. The court below has also erred in refusing to take into consideration the sale exemplars produced by the HSIIDC on the ground that the aforesaid sale deeds reflect a price lower than the amount awarded by the LAC and therefore, these cannot be taken into

consideration. The Reference Court has further erred in observing that the LAC has assessed the land on the basis of the Collector's rate, whereas it is proved on the file that the State Government had constituted a Committee headed by the Commissioner of the concerned Division for assessing the market value of the acquired land. Further, while drawing the attention of the Court to the sale deeds produced by the State, he contends that even if the sale deeds with regard to the smaller sized plots are ignored and the six sale deeds showing the higher price are taken into consideration, still the average price per acre will come to 9,79,486/-.

Further, he contends that the sale ₹ deeds, relied upon by the Court, have mostly been executed and registered in the month of October, 2005, whereas the notification under Section 4 of the 1894 Act is dated 02.12.2005. He submits that the afore referred sale deeds have been executed only to jack up the price or mislead the Court. 4.2 Per contra, the learned counsels representing the land owners have relied upon the allotment letter issued by the HSIIDC on 27.04.2006 with respect to a hotel site, whereby 3456 square meters of the area was sold for a total consideration of 15,50,00,000/-. They further contend that the ₹ Court has erred in applying 50% cut towards the development charges. They rely upon the judgment passed by the Hon'ble Supreme Court in Major General Kapil Mehra v.

Union of India (2015) 2 SCC 262 to contend that only 30% cut could have been imposed. The HSIIDC has already developed the adjoining area as a large number of industries have come up.

M/s Asian Cane Limited, M/s Haryana Pashpati Woolen Limited, M/s Musashi Limited, M/s YKK Limited and M/s Nerolac Limited, have already set up their industries and started operating from the nearby area. It has further been alleged that the Bawal Town is located at 1-2 Kms. and the National Highway No. 72 passes close to the acquired land. The Maharishi Vidya Mandir Public School and Research Center of the Haryana Agricultural University, Hisar, have also come up in the nearby area. They further, while drawing the attention of the Court to the acquisition of the land in village Rudh vide notification dated 08.04.2004, contend that the Reference Court had assessed the market value of the land @ 24,36,000/- ₹ per acre. While relying upon the judgment passed in Special Land Acquisition Officer & Another v. M.K. Rafiq Saheb (2011) 7 SCC 714, they submit that the sale deeds of the smaller sized plots cannot be ignored by the Court while assessing the market value.

5.

DISCUSSION 5.1 The market value of the acquired land is to be determined on the date of issuance of the notification under Section 4 of the 1894 Act i.e. 02.12.2005. In other words, the crucial date for determination of the market value of the land in these cases is 02.12.2005. Section 15 of the 1894 Act provides that the Collector shall be guided by the provisions contained in Section 23 and 24 of the 1894 Act in determining the amount of compensation. Section 23, 24 and 25 of the 1894 Act are extracted as under:- "23. Matters to be considered in determining compensation-

(1) In determining the amount of compensation to be awarded

for land acquired under this Act, the Court shall take into considerationfirst the market-value of the land at the date of the publication of the notification under Section 4, sub-section (1). secondly the damage sustained by the person interested, by reason of the taking of any standing crops or trees which may be on the land at the time of the Collector's taking possession thereof;

thirdly the damage (if any) sustained by the person interested, at the time of the Collector's taking possession of the land, by reason of severing such land from his other land; fourthly the damage (if any) sustained by the person interested, at the time of the Collector's taking possession of the land, by reason of the acquisition injuriously affecting his other property, movable or immovable, in any other manner, or his earnings;

fifthly if, in consequence of the acquisition of the land by the Collector, the person interested is compelled to change his residence or place of business, the reasonable expenses (if any) incidental to such change, and sixthly the damage (if any) bona fide resulting from diminution of the profits of the land between the time of the publication of the declaration under Section 6 and the time of the Collector's taking possession of the land.

(1-A) In addition to the market-value of the land, as above

provided, the Court shall in every case award an amount calculated at the rate of twelve per centum per annum of such market-value for the period commencing on and from the date of the publication of the notification under Section 4, subsection (1), in respect of such land to the date of the award of the Collector or the date of taking possession of the land, whichever is earlier.

Explanation.-In computing the period referred to in this subsection, any period or periods during which the proceedings for the acquisition of the land were held up on account of any stay or injunction by the order of any court shall be excluded. (2) In addition to the market-value of the land, as above provided, the Court shall in every case award a sum of[thirty per centum] on such market-value, in consideration of the compulsory nature of the acquisition.

Matters to be neglected in determining compensation -But the Court shall not take into considerationfirst, the degree of urgency which has led to the acquisition; secondly, any disinclination of the person interested to part with the land acquired;

thirdly, any damage sustained by him, which, if caused by a private person, would not render such person liable to a suit; fourthly, any damage which is likely to be caused to the land acquired, after the date of the publication of the declaration under Section 6, by or in consequence of the use to which it will

be put;

fifthly, any increase to the value of the land acquired likely to accrue from the use to which it will be put when acquired; sixthly, any increase to the value of the other land of the person interested likely to accrue from the use to which the land acquired will be put;

seventhly, any outlay or improvements on, or disposal of, the land acquired, commenced, made or effected without the sanction of the Collector after the date of the publication of the [notification under Section 4, sub-section (1); or eighthly, any increase to the value of the land on account of its being put to any use which is forbidden by land or opposed to public policy.

25. Amount of compensation awarded by court not to be lower than the amount award by the Collector - The amount of compensation awarded by the Court shall not be less than the amount awarded by the Collector under Section 11." 5.2 On a careful scanning of the aforesaid provisions, it becomes crystal clear that while determining the market value, the matters which are required to be considered have been enlisted in Section 23 of the 1894 Act whereas the matters which are to be ignored are enlisted in Section 24 of the 1894 Act. This Court, while interpreting the provisions in Haryana State Industrial & Infrastructure Development Corporation v. Kulbir and Others (Regular First Appeal No. 4163 of 2017, decided on 01.09.2017) has observed as under:-

"4.5 It is apparent from the reading of the first part of Section 23 of the 1894 Act that the market value of the land is required to be determined on the date of publication of the notification under Section 4 (1) of 1894 Act. Hence, the crucial date for determining the market value is 09.06.2006. No further guidelines for assessment of the amount have been provided in the 1894 Act.

Sub-section 1-A of section 23 of the 1894 Act provides that while determining the amount of compensation to be awarded for the land acquired, the court apart from the market value of the land, is also required to award an amount calculated at the rate of 12% per annum at such market value for the period commencing on and from the date of publication of notification under Section 4 (1) of the 1894 Act till the date of award passed by the Collector or till the date of taking possession of the land, whichever is earlier. Under sub-section 2 of section 23 of the 1894 Act, the court, in addition to the market value of the land, is required to award a sum of 30% on such market value towards compulsory nature of the acquisition.

Section 24 of the 1894 Act enlists the various factors which are required to be ignored while determining the market value. Section 25 of the 1894 Act provides that the court shall not award the amount of compensation which is lower than the amount awarded by the Collector.

4.6 It is apparent from the reading of the aforesaid statutory provisions that while determining the market value of the

acquired land, the court is required to examine the existing geographical location of the acquired land apart from its existing and potential use. The Court is also required to examine as to whether the acquired land has proximity to the National Highway or the State Highway Road or any developed area. The market value of the other land situated in the same locality/area or adjacent to or very near to the acquired land can also be taken into consideration by the Court. While assessing the market value, the Court is required to see as to what would be the price on which a willing seller would sell the land to a willing purchaser. While assessing such compensation, one of the method is to assess the market value by comparable sale method i.e. by referring to contemporaneous transactions.

4.7 While adjudicating the market value of the acquired land, the Courts are expected to award "just" and "appropriate" amount on the basis of the material available on record. The Court is not expected to distribute the public money with largesse. It is the duty of the Court to maintain a proper equilibrium between the interest of the parties and the public interest, in general. If the Courts lean in favour of the landowners, the government or the allottees are likely to be unnecessarily overburdened and it will result in distributing the public money without limits thereby impacting the public interest, at large whereas if the courts are inclined towards the

government, it can result in undermining of just claims. Therefore, a proper balance has to be drawn guided by the facts of case and to preserve the public interest and the public resources, as a whole".

5.3 Apart from the sale deeds, the owners have also relied upon certain judgments of various Courts assessing the amount of market value with respect to the acquisition of land in the area. Firstly, it would be appropriate to notice the aforesaid judgments/awards passed by the Courts and the LAC. With respect to the acquisition of the land measuring 19 kanals and 17 marlas in village Rudh vide notification under Section 4 of the 1894 Act dated 08.07.2004, the Reference Court assessed the market value of the land @ 24,36,000/- per acre. However, the village Rudh is not a part of this ₹ acquisition. Furthermore, the owners have failed to lead any evidence to prove that the land at village Rudh is identically situated as the land in the present case or as to the factors which show parity in the price of the land in these two villages.

Such assessments can be relied upon by the Court only if parity is established in every sphere by leading evidence. Once there exists numerous sale exemplars, it is not appropriate to solely rely upon an assessment by the Court, particularly when the evidence to prove parity in every sphere is lacking.

5.4 The next judgment relied upon by the land owners is in Ashrafi and Others v. State of Haryana and Others (2013) 5 SCC 527. This judgment has been relied upon to impress that the cut applied by the reference court is excessive. It should be only 1/3rd and not 50%. The next judgment relied upon by the owners is in Regular First Appeal No. 207 of

2006 decided on 21.01.2016 (Kishan and Others v. State of Haryana and Others and other connected cases). In this case, vide notification under Section 4 of the 1894 Act dated 18.05.1999, 373 kanals and 18 marlas of land located in village Asalwas was acquired which is one of the villages involved in these appeals. The Court has assessed the market value of the land @ 12,37,840/- per acre. Apart from that, reliance is also placed upon ₹ the award No. 9 dated 04.12.2014 relating to the acquisition of the land in village Deodhi vide notification under Section 4 of the 1894 Act dated 14.02.2011.

The LAC had assessed the market value of the land @ 70,67,138/- The award, in the last mentioned case, was passed under the ₹ Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (hereinafter referred to as "the 2013 Act") which came to be enforced w.e.f. 01.01.2014. The land located in village Deodhi is not a part of the present acquisition and the evidence to prove that the land of village Deodhi is comparable with the acquired land is not available. Further, once the sale exemplars of the land situated in the same village are available, it is not appropriate to rely upon the assessment made by the Collector with respect to another village. 5.5 The owners have further relied upon the decision of the High Court in Executive Engineer/Construction, Northern Railway Rohtak v.

Mamchand and Others (Regular First Appeal No. 2189 of 2012, decided on 13.05.2016). Acquisition of the land in the aforesaid case was initiated on 28.06.2007 by issuing a notification under Section 4 of the 1894 Act to acquire the land in the villages of Palhawas, Chandanwas and Rohrai. The Court has assessed the market value of the land @ 70,40,000/- per acre.

However, the land of these villages is not a part of the acquisition in question. The owners have also relied upon the award No. 16, 17, 18, 19, 20 and 21 of 30.11.2016, respectively, issued by the Competent Authority under the National Highways Act, 1956 (hereinafter referred to as "the 1956 Act"). In all these cases, the notification under Section 3A of the 1956 Act was issued on 10.09.2008 and the Competent Authority under the 1956 Act has assessed the market value of the acquired land between 1,00,00,000/- per ₹ acre to 1,23,33,300/- per acre. However, this acquisition is approximately ₹ 3 years after the issuance of the notification under Section 4 of the 1894 Act in the present case. They have also relied upon the judgment passed by the High Court in Nand Ram and Others v. State of Haryana and Others (Regular First Appeal No.

3541 of 2006 decided on 14.09.2010), wherein vide notification under Section 4 of the 1894 Act dated 11.12.1995, the land situated in the villages of Chirhara, Jaliawas, Suthani, Asalwas, Suthana and Jalalpur was acquired. The matter was finally determined by the Hon'ble Supreme Court in HSIIDC v. Nand Ram and Others (Civil Appeal No. 9553 of 2011, decided on 26.11.2014) wherein while resorting to the determination made by the Reference Court, the Court held that the owners shall be entitled to 8,00,000/- per acre upto the depth of 500 yards from the ₹ national highway, whereas the owners on the remaining land were held entitled to the market value of the land @ 6,00,000/- per acre.

In the ₹ absence of any other evidence, the court may have attempted to assess the market value on the basis of the assessment made by the Hon'ble Supreme Court in Nand Ram's case (supra) by applying appropriate increase for every passing year, however, such method is fraught with huge risk.

market value never increases constantly and consistently. The increase of price of land is never in a straight line and there can never be a constant and uniform increase in the value every year. However, once the parties have produced sale deeds of contemporaneous period which are considered sufficient for the court to arrive at a conclusion with a reasonable certainty, then it is not appropriate to rely upon such assessment made way back in the year 1995 i.e. ten years prior to the acquisition in the present case. 5.6 Reliance is also placed upon the judgment passed by the Reference Court on 09.02.2011 while assessing the market value of the land as on 06.01.2006.

The Court has assessed the market value of the land @ 1,700/- square yard with respect to the land which was utilized for ₹ developing Sector 6 and 7 by the Haryana Urban Development Authority, Rewari. The owners have failed to bring any evidence to prove its comparative location with the acquired land in the present case. They have also relied upon the judgment passed by the Additional District Judge on 21.01.2012 when the acquisition of land in village Dhailwas was initiated by issuing the notification under Section 4 of the 1894 Act on 27.01.2003. The Reference Court had assessed the market value of the land @ 20,00,000/- ₹ per acre. However, no evidence to prove its comparative location viz-a-viz the acquired land has been led. They have also relied upon a judgment passed by the Reference Court on 25.11.

The next judgment relied upon by the owners is the award of the Reference Court dated 26.02.2013 with respect to the acquisition of the land in the Rewari City vide notification dated 21.08.2003 wherein the Reference Court had determined the market value of the land @ 1,650/- per square yard. The Reference Court, in the present case, has not ₹ relied upon the aforesaid document as no evidence to compare the location of the acquired land in the present case and the acquired land in the aforesaid case was led.

5.7 The next judgment relied upon by the owners is with respect to the acquired land located in village Lisana vide notification under Section 4 of the 1894 Act issued on 06.11.2006. The Reference Court vide judgment dated 11.08.2010 assessed the market value of the land @ 20,00,000/- per ₹ acre. The village Lisana is not a part of the present acquisition and the owners have again failed to lead any evidence to prove its comparative location. They have further relied upon the award No. 31/R of 2006-07 with respect to acquisition of land in the village Chandpur vide notification dated 27.01.2003 under Section 4 of the 1894 Act. The LAC had assessed the amount @ 12,50,000/- per acre.

₹ 5.8 Furthermore, the land owners have relied upon award No. 23 of the year 2006-07 with respect to the acquisition of 299.46 acres of land in village Rewari. The acquisition was initiated vide notification dated 06.01.2006 under Section 4 of the 1894 Act of the 1894 Act. The LAC had assessed the market value @ 12,50,000/- per acre. Additionally, the land ₹ owners have also relied upon the award No. 31 of the year 2006-07 acquiring 95.36 acres of land located in the village Chandpur and the

notification under Section 4 of the 1894 Act, in this regard, was issued on 27.01.2003. The LAC had assessed the market value @ 12,50,000/- per ₹ acre. The land owners have also relied upon award No. 32 of the year 200607 with respect to the acquisition of the land measuring 103.90 acres of land in the village Piwra and the relevant notification under Section 4 of the 1894 Act was issued on 27.01.2003. The LAC had assessed the market value @ 12,50,000/- per acre.

₹ The owners have also relied upon the judgment passed by the Reference Court on 30.09.2009 with respect to the acquisition of the land in the village Padiawas. The acquisition was initiated vide notification under Section 4 of the 1894 Act dated 21.07.2003 and was completed vide an award No. 35 by the LAC. However, the village Padiawas is not a part of the present acquisition and there is no evidence on record to prove its comparative location. Hence, the determination made by the various Courts and the assessment made by the Land Acquisition Collector in all the cases referred to above does not help the Court to determine the market value of the acquired land in the present appeals.

This Bench endeavoured to take into consideration the awards passed by the authorities under the 1956 Act in the year 2000 while making an attempt to impose an appropriate cut. However, from a glance at item No. 33 in Table "A", it is apparent that the land measuring 4 kanals and 3 marlas located in village Karnawas has been sold @ 5,71,000/-. The average price comes to ₹ 11,00,722/-. This sale deed is approximately after a period of two years ₹ from the date of notification issued under Section 4 of the 1894 Act in the present case. This is an indication that the prices of the agricultural land did not increase by leaps and bounds.

5.9 Furthermore, it is evident that there is no prohibition for the Court to take into consideration the sale deeds depicting the price lower than the amount assessed by the LAC. Section 25 of the 1894 Act only debars the Court to award an amount lower than the amount awarded by the Collector (Lal Chand v. Union of India and Another (2009)5 SCC 769). Thus, the Additional District Judge has erred in refusing to take into consideration the sale exemplars produced by the State. 5.10 The Reference Court has also committed an error in taking into consideration the sale deeds at item No. 16 and 28 to 31 while assessing the market value of the acquired land. The land in all these sale deeds is not agricultural in nature. It is evident on a careful perusal of Table "A" that the sale deed at item No.

16 is only with respect to 15 marlas of land and the sale deeds from item No. 29 to 31 are also of land measuring less than 1 kanal. The sale deed at item No. 28 is with regard to a residential plot, although of a reasonable size. The Reference Court, after taking the average of these six sale deeds has chosen to apply a cut to the extent of 15% as development expenses and thus, arrived at a conclusion that the market value is @ 19,30,491/-. It is apparent that the Reference Court has ignored ₹ the sale deed of the agricultural land at item No. 2 and 33 of Table "A" and the sale deeds produced by the HSIIDC in Table "B". 5.

11 Furthermore, while assessing the market value of the agricultural land measuring more than 1000 acres, the Court cannot be expected to determine the market value on the basis of the sale exemplars of the non-agricultural land like commercial and residential plots of very small sizes.

upon such sale exemplars after finding that there is no comparable sale exemplar. However, in the present case, the sale exemplars of the agricultural land with regard to the period immediately prior to the issuance of the notification under Section 4 of the 1894 Act are available. Thus, the Reference Court committed an error while relying upon the sale deeds of the residential plots of smaller sizes and ignoring the sale deeds of the agricultural land. A marla of land is 1/160th part of an acre of land. The Reference Court has also overlooked that the land owners of village Suthani did produce Ex.P5/B, a sale deed dated 29.08.2005 (at item No. 2 in Table "A") with respect to the land measuring 4 kanals and 15 marlas for a sale consideration of 7,15,000/-. The per acre price works out to 12,04,210/-.

₹ ₹ In fact, the land owners have produced the sale deed noted at item No. 2 and 33 in Table "A" with respect to the sale of the agricultural land before the issuance of the notification under Section 4 of the 1894 Act. The remaining sale deeds are with respect to land for residential or commercial purposes. The sale deed dated 04.07.2003 (Ex.PW.5/A at item No. 36 in Table "A") is with respect to the land measuring 16 kanals, located in village Jaliawas, which is an industrial plot sold along with the building for a total consideration of ₹ 27,70,502/-. The average price works out to 13,85,251/- ₹ per acre. M/s Mahavir Foods has sold the existing industry along with the building. Thus, the aforesaid sale deed cannot be relied upon to determine the market value of the agricultural land.

At this stage, it is important to examine the sale exemplars at item No. 28 in Table "A". This sale deed is with respect to a residential plot measuring 2 kanals. Hence, this cannot be made the basis to assess the market value of the land in question.

owners have also produced the sale deeds dated 10.04.2008 (Item No. 38 in table A), 12.12.2007 (item No. 39 in table A) and 16.11.2007 (item No. 40 in table A). These are with respect to the land measuring 85 kanals 16 marlas, 32 kanals 04 marlas and 58 kanals 15 marlas, respectively. However, these sale exemplars cannot be relied upon as these have been executed subsequent to the date of issuance of the notification under Section 4 of the 1894 Act in the present case and even the land alleged to be sold is located in village Deodhai. No evidence has been led to prove the comparative location of the land situated in village Deodhai with the acquired land. 5.12 The HSIIDC has produced copies of various sale deeds of the agricultural land/plots of various sizes.

From a careful examination of the information compiled in the tabulated form, it is apparent that in item No.24 of Table "B", the sale is of nearly 4 acres of land. The land has been sold at the rate of 2,98,013/- per acre in village Bawal. Vide sale deeds dated ₹ 14.03.2005 (item No. 11) and 13.06.2005 (item No. 27), the land has been sold on an average price ranging between 10,00,000/- to 11,00,000/- ₹ ₹ .

Apart therefrom, there is a sale of the land measuring 2 acres in village Suthani on 15.04.2003 (item No. 41 in Table "B") for a sum of 8,00,000/-, ₹ the average price per acre comes to 4,00,000/- only. Even if the Court ₹ ignores the sale deeds of smaller plots of agricultural land produced by the HSIIDC and relies upon the sale deed depicting the highest sale price, it is still nowhere comparable to the amount awarded by the Reference Court. The LAC has assessed the market value of the land @ 12,50,000/- per acre. ₹ It is important to note that the official of the HSIIDC i.e. Ashok Kumar, who appeared as RW.2 in the case arising from the village Bawal, has admitted

that the HSIIDC has already developed some part of the land in 9 villages i.e. Chirhara, Suthana, Suthani, Jaliawas, Asalwas, Banipur, Jalalpur, Rudh, Patukhera in the year 1992, 1995, 2005 and 2008, respectively, on both the sides of the NH-8. The plots have already been allotted to the industries and the factories have been built and have started operating. Despite this, the market value of the land did not show any upward trend. Moreover, the Court is required to determine the market value of the land on the basis of the evidence produced. The Court is required to look for comparable sale transactions while assessing the market value on the basis of contemporaneous sale transactions. Once the Court is called upon to assess the market value of an agricultural land and the comparable sales transactions of agricultural land are available, it is not appropriate to rely upon the sale deeds of the residential or the commercial plots of minuscule sizes.

5.13 The learned counsel representing the land owners have heavily relied upon the allotment of plot measuring 3456 square meters as a hotel site for 15,50,00,000/-. However, it has come in the evidence, which is not ₹ disputed by the land owners, that the aforesaid allotment was cancelled and the plot was re-transferred vide order dated 19.04.2012 as the allottee failed to pay the amount. Furthermore, a hotel site in a developed area, which is expected to be located in a prime area, cannot be relied upon to assess the market value of an agricultural land.

5.14 The learned counsel representing the land owners have also drawn the attention of the Court to the assessment of the market value of the land by the various Reference Courts. It would be noted here that the ideal

judicial determination of the market value of the land is by the Hon'ble Supreme Court in Nand Ram's case (supra). In the aforesaid case, the Court assessed the market value of the land of the same villages as on 11.12.1995 @ 6,00,000/- per acre. The learned counsels have submitted that the ₹ market value of the land should be arrived at by adding an increase of 12% per year. In the absence of other sale exemplars of contemporaneous period, the Court may be required to resort to the aforesaid method. However, as already noticed, in the present case, in the year 2005 itself, there are at least three sale deeds of approximately 4 acres of land showing that the sale price has been revolving around 10,00,000/- per acre. In such a situation, it is not ₹ prudent for the Court to assess the market value by overlooking the direct evidence, while resorting to an assessment of the market value based upon assumptions.

5.15 Moreover, the oral evidence led by the parties, at the most, prove that the acquired land has the potential to be used for industrial purposes, however, this in itself is not sufficient to arrive at the market value of the acquired land. Once, the sale deeds of the comparable land are available, the oral evidence cannot be relied upon to determine the market value. The parties have also produced the various site plans/layout plans but they are of no significance. No effort has been made to depict/identify the location of the plots represented by various sale deeds viz-a-viz the acquired land. The parties ought to have produced a comprehensive layout plan to enable the Court to compare the location of the various pieces of land sold by the sale deeds produced in the evidence and compare the same. 5.16 Now, let us analyse the judgments relied upon by the learned

counsels representing the land owners. The first judgment is Major General Kapil Mehra's case (supra). In the aforesaid case, 12 bighas land in Vasant Kunj, Delhi, was sought to be acquired for developing Vasant Kunj. The Court, after finding that the comparable sale deeds are of smaller plots when compared to the extent of land sought to be acquired, directed that 35% deduction towards the development shall be appropriate to arrive at the market value of the acquired land. The relevant discussion is in para 29 to 41 of the SCC Report.

In the present case, once the comparable sale deeds of contemporaneous period are available with respect to the agricultural land, then in the considered view of this Court, it is not appropriate to rely upon the sale deeds of the smaller plots which are being sold and purchased for residential and commercial purposes. In the present case, the Court is called upon to determine the market value of a land which is agricultural in nature and was being used for agricultural purposes. 5.17 As regards the judgment in M.K. Rafiq Saheb's case (supra), it is noted that the Supreme Court applied a 60% cut, after noticing that the price is required to be determined by comparable sales method, while relying upon the plots of a smaller area.

In the aforesaid case, the Court found that the comparable sale deeds, of pieces of a land of a reasonable size, were not available. In those facts, the Court applied deduction to the extent of 60%. However, as already noticed, in the present case, a large number of sale exemplars have been produced including that of an agricultural land. Hence, with highest respect, the aforesaid judgments, relied upon by the learned counsel representing the land owners, are not applicable.

5.18 At the time of hearing, the learned counsel representing the HSIIDC was requested to inform the Court as to whether the enhanced payment has been made to the landowners or not. The learned senior counsel has informed the Court that the landowners have already been paid @ 16,00,000/- per acre. It is left to the State to take a call on the question ₹ whether it intends to recover the excess amount from the farmers or not. By now, the HSIIDC might have passed on the burden of the amount of acquisition on the allottees of the industrial plots. In such an eventuality, it may not appropriate for the HSIIDC to unjustly enrich itself. 5.19 Keeping in view the aforesaid facts, this court finds that the Reference Court has assessed the market value of the land without appreciating the evidence in a proper perspective and therefore, all the reference applications are required to be dismissed. 5.20 In view of the discussion made in the foregoing paragraphs, the appeals filed by the HSIIDC are allowed whereas that of the land owners are hereby dismissed.

5.21 The miscellaneous application(s) pending, if any, shall also stand disposed of.
