The present revision petition has been filed against the judgment of conviction and order of sentence dated 12.04.2023, whereby the learned Chief Judicial Magistrate, Moga, convicted the petitioner and sentenced him to undergo rigorous imprisonment for a period of two years and to pay a fine of Rs.1000/- and in default of payment of fine, to further undergo rigorous imprisonment for a period of 15 days for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. The petitioner has further challenged the judgment dated 05.10.2023, whereby the appeal filed by the petitioner against the judgment of conviction and order of sentence dated 12.04.2023 has been dismissed by the learned Additional Sessions Judge, Moga.

At this stage, learned counsel for the respondent/complainant submits that the matter has been amicably settled between the parties and the complainant has no objection if the petitioner is acquitted and the impugned judgment of conviction and order sentence is set aside. 3.

In view of the submission of learned counsel for the respondent/complainant, the present revision petition is allowed. The impugned judgment of conviction and order of sentence dated 12.04.2023 as well as the impugned judgment dated 05.10.2023 are set aside. The petitioner is acquitted of the notice of acquisition. 4.
