Prayer is for grant of anticipatory bail in case FIR No.96 dated 29.07.2023, under Section 420, 120-B, IPC, registered at Police Station Sadar, Sangrur, District Sangrur (Annexure P-1). 2.

In compliance of order dated 04.10.2023, learned State counsel on instruction from ASI Pushpinder Singh, submits that the petitioner has joined the investigation, however, recovery of almost Rs. 20,00,000/- is yet to be effected.

Learned counsel for the complainant has submitted that the intention of the petitioner has to be seen from the fact that after executing the agreement to sell with the petitioner and taking money from him, his partner has sold the same land to somebody else. Keeping the right of the respondent-complainant reserved subject to his discretion, the present petition is disposed of. The order dated 04.10.2023 granting interim anticipatory bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.
