Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent - Department to release arrears of revised pay/pension to the petitioner, accrued on account of implementation of 6th Punjab Pay Commission in view of letter dated 29.10.2021 (Annexure P-2).

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding legal notice dated 16.05.2024 (Annexure P-4). He submits that at this stage, petitioner would be satisfied, if the said legal notice is considered and decided by passing a speaking order in a time bound frame.

Mr. Rajesh Sehgal, Addl. A.G., Punjab, accepts notice on behalf of respondents No.1 and 2 whereas Mr. J.S. Gill, Advocate, has accepted notice on behalf of respondents No.3 to 5. 5.

I have heard learned counsel for the parties and have gone through the record of the case.

Without expressing any opinion on the merits of the case or the claim being made by the petitioner in the present petition, respondent No.3 is directed to consider and decide the legal notice dated 16.05.2024 (Annexure P-4) in accordance with law, by passing a speaking order within a period of three months from the date of receipt of certified copy of this order. In case, the petitioner is found entitled, necessary benefits be released to him within a period of three weeks thereafter.

The petition stands disposed of.
