The present petition has been filed under Section 528 BNSS, 2023, for the issuance of directions upon the learned Judicial Magistrate Ist Class, Talwandi Sabo, District Bathinda in case bearing No. CRM-198 of 2023 titled as 'Amandeep Singh versus Simarjit Kaur' to proceed with the application filed by the petitioner under Section 340 Cr.P.C. in complaint No. COMA-349 of 2016 titled as Simarjit Kaur versus Amandeep Singh and others, in a time bound manner.

Learned counsel for the petitioner submits that the petitioner is the brother-in-law (jeth) of respondent No. 2. The marriage of the younger brother of the petitioner was solemnized with respondent No. 2 in the year 2015. After sometime, some matrimonial differences ensued between them, leading to filing of a petition under Section 12 of the Domestic Violence Act, 2005 by respondent No. 2. The said petition was allowed by the trial Court vide order dated 18.3.2023 (Annexure P-1) and the petitioner along with his brother were jointly and severally directed to pay a sum of Rs. 15,000/- per month to respondent No. 2. CRM-M-42187-2025 -2in which stay has been granted and the said appeal is pending adjudication. It has further been stated that the petitioner has also filed an application under Section 340 Cr.P.C. before the learned Court concerned detailing therein the transgressions of respondent No. 2, whereby she has deliberately tendered certain incorrect and false statements, including her marital status, in the proceedings before the learned Judicial Magistrate Ist Class, Talwandi Sabo, Bathinda. It is stated that though notice has been issued in the said application, however, the matter is pending consideration before the Court concerned as reply has not been furnished by respondent No. 2 till now and she has been intentionally and deliberately delaying the matter. Learned counsel for the petitioner submits that the petitioner would be satisfied if, appropriate directions are issued to the learned trial Court concerned to conclude the trial expeditiously.

At the asking of the Court, Ms. Guramrit Kaur, DAG, Punjab accepts notice on behalf of respondent No. 1. Let a complete set of the paper-book be supplied to her during the course of the day. 5.

In view of the limited prayer made by the learned counsel for the petitioner and without commenting on the merits of the case, the present petition is disposed of. The learned trial Court concerned is encouraged to conclude the trial expeditiously.
