The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking directions to the respondents to re-issue passport.

The petitioner was issued passport on 24.03.1997 which expired on 23.03.2007. An FIR No.7 dated 03.03.2006, under Section 7 read with Section 13(2) of Prevention of Corruption Act, 1988 at Police Station Vigilance Bureau, Amritsar, came to be registered against the petitioner. The petitioner was convicted and awarded sentence of 11⁄2 years. The petitioner has preferred CRA-S-2628-SB-2010 before this Court which vide order dated 01.11.2010 has suspended his sentence. The petitioner vide application dated 03.06.2023 applied for re-issuance of passport, however, respondents have rejected his application on the ground of pendency of appeal.

Learned counsel for the respondents-UOI submits that the competent authority would pass an appropriate order within 06 weeks after considering the judgment of this Court in Mohan Lal @ Mohna's case (supra).
