(Oral) The present petition is for issuance of writ in the nature of mandamus directing the respondent to consider and decide the parole case of the petitioner, which is pending with the respondents. On notice, a reply dated 19.01.2022 by way of affidavit of officiating Supdt. Central Jail, Patiala has been filed on behalf of respondent Nos. 1, 2 and 4 stating therein that the case of the petitioner for grant of parole has already been declined on 12.01.2022 by District Magistrate Sangrur (R-1).

Today also, a reply dated 25.02.2022 by way of affidavit of DSP, Sub Division, Moonak has been filed on behalf of respondent Nos. 1 and 3 and the same is taken on record. As per this reply, the necessary verification was got made through SHO, Moonak and DSP, Sub Division, Moonak and from the verification, it was found that in F.I.R No. 82 dated 06.07.2019 under Section 376 (3), 376 (2), 452 IPC and under Section 6 of GAURAV ARORA 2022.03.07 16:48 I attest to the accuracy and integrity of this document Chandigarh

CRWP No. 12117 of 2021 POCSO Act, 2012, at P.S. Moonak, the petitioner is undergoing rigorous imprisonment for 20 years in Central Jail, Patiala. Thus, his case was not recommended for grant of parole.

Faced with the situation, learned counsel for the petitioner wishes to withdraw the present petition with the liberty to challenge order dated 12.01.2022 passed by District Magistrate Sangrur (R-1). Dismissed as withdraw with the aforesaid liberty.
