The instant petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed here-under:- Name of Petitioner(s) FIR No.

Learned counsel for the petitioner reads out the vernacular of the FIR and submits that petitioner is attributed a datar blow on right leg of injured Ravijot Singh. In fact, there is no injury on right leg, corroborating the factual allegations mentioned in FIR. Injured Ravijot Singh has suffered total 05 injuries and 03 of the injuries are already declared simple and injuries No.2 and 4 have been declared grievous in nature. In fact, injury No.2, which is opined to be grievous in nature is on the left leg below the
- 2 - knee and injury No.4 is on little finger of the left hand of injured Ravijot Singh.

Thus, counsel contends that in fact, there being no injury on the right leg of injured, his involvement seems to be highly doubtful. Moreover, petitioner has already undergone incarceration period of more than 04 months inside jail, thus prays for grant of regular bail. 4.
Learned counsel for the petitioner on examining the facts from record is unable to dispute the factual averment, though submits that, may be inadvertently, complainant mentioned the injury to be on right leg instead of left leg.
In addition, counsel also submits that similarly situated coaccused - Harvinder Singh alias Deepu, has been granted concession of regular bail by this Court vide order dated 14.07.2025, passed in CRM-M35444-2025, titled as, "Harvinder Singh alias Deepu v. State of Punjab and another" (Annexure P-2). Therefore, claiming parity, learned counsel prays for grant of concession of regular bail to the petitioner. 5.
On the other hand, learned State counsel is unable to controvert the submission that petitioner has already suffered incarceration of 05 months (wrongly mentioned as 04 years in the co-accused bail order, i.e., CRM-M-35444-2025) and the offences are triable by the Court of Magistrate and involvement of the petitioner is still to be established by the prosecution.
However, he vehemently submits that if the petitioner is granted concession of bail, there is every likelihood of him being absconding from the trial and again can indulge in similar kind of activities.

I have heard learned counsel for the parties and perused the relevant material available on record.

As per the totality of circumstances, and the facts/allegations levelled against the petitioner, and the factors noticed here-above, I deem it appropriate to grant the concession of bail to the petitioner. Consequently, prayer made in the present petition is allowed. Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case.

Needless to observe that the petitioner shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly.

Any of the discussion done and recorded here above, shall not be construed as an expression of opinion on the facts of the case. Therefore, trial Court is expected to decide the case by taking an independent view, on the basis of evidence available on record, as expeditiously as possible, in accordance with law.
