PRESENT: MR. PANKAJ GARG, ADVOCATE FOR THE PETITIONER. DEEPAK MANCHANDA, J.(ORAL) The petitioner has preferred this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.16 dated 14.1.2020, under Section 379-B, 201 IPC, Police Station City-2, District Mansa. Learned counsel for the petitioner contends that the petitioner was granted the concession of regular bail by the trial Court in the aforesaid FIR vide order dated 13.3.2020. But, on 9.3.2022, the petitioner could not appear before the trial Court due to noting down of a wrong date of hearing. Therefore, his bail was cancelled vide order dated 9.3.2022 by the learned trial Court and his bail bonds were forfeited to the State and when he appeared before the trial Court on 3.9.2022, he was taken into custody.

He further submits that the absence was totally unintentional. He prays for bail. Mr. Gurdarshan Singh Sidhu, AAG, Punjab has filed custody certificate of the petitioner and submits that the petitioner is involved in other cases also of similar nature, however he is on bail in all those cases. He further submits that the order of cancellation of bail of the SUMIT GULATI 2022.12.

CRM-M-50212-2022 -2petitioner has been issued only on the sole ground of absence of the petitioner.

After hearing learned counsel for the parties and considering that the absence caused was unintentional and due to wrong noting of date of trial, it is ordered that the petitioner be released on regular bail in the above case, subject to his furnishing requisite bail bonds/surety bonds to the satisfaction of the trial Court concerned.

The petition is allowed.
