The instant petition has been filed on behalf of the petitioner seeking grant of regular bail in respect of aforementioned FIR. 2.

The allegations, in nutshell, are that the petitioner had impersonated as Akwinder Kaur and had appeared in a written examination in place of Akwinder Kaur where she was caught on the spot. 3.

CRM-M-45765-2024 (O&M) - 2 - investigation and trial is likely to consume time, the petitioner may be released on bail.

Opposing the petition, learned State counsel submits that since the petitioner was caught red-handed at the spot while impersonating as Akwinder Kaur, no leniency is warranted. It has however, been informed that the petitioner as on date has been behind bars since the last about 1 year and 20 days and that challan has not been presented so far.

This Court has considered rival submissions addressed before this Court.

Without commenting anything as regards the merits of the case, but having regard to the fact that the petitioner is a lady and has been behind bars since the last more than 1 year and has a clean record, further detention of the petitioner would not be justified. The instant petition, as such, is accepted and the petitioner is ordered to be released on regular bail on her furnishing bail bonds/surety bonds to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
