Instant petition has been filed under Section 439 Cr.P.C seeking grant of regular bail to the petitioner in case FIR No.125 dated 20.08.2018 registered under Sections 342, 363, 452, 376, 506, 34 of Indian Penal Code, 1860 (for short "IPC") and subsequently, Section 368 IPC and Section 6 of Protection of Children from Sexual Offences Act, 2012 have been added, at Police Station Nangal, District Rupnagar. During the course of arguments, upon instructions from ASI Gurnaib Singh, State counsel submits that the prosecutrix is 16 years of age and out of 04 accused, main accused, Rohit has been convicted and sentenced for a period of 20 years and accused Seema has been acquitted. The remaining two co-accused, Vishal and Sunny, who were brothers, were declared as Proclaimed Offender on 27.09.2019 and after their arrest in SAVITA KADIAN 2022.02.08 16:06 I attest to the accuracy and authenticity of this document High Court Chandigarh

CRM-M-55 of 2022 {2} September, 2021, challan has been presented on 11.10.2021. He has instructions to state that the charge against the petitioner and co-accused Sunny, is yet to be framed.

After arguing for sometime and realizing that the Court is not inclined to agree with his submissions, counsel for the petitioner seeks and is granted permission to withdraw the petition. Dismissed as withdrawn.
