Amit Kumar Kaushik v. Rajesh Saroha And Others
CR-5282-2025
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH Sr. No.120 CR-5282-2025 Date of Decision:07.08.2025 AMIT KUMAR KAUSHIK
...Petitioner
Versus
RAJESH SAROHA AND OTHERS .....Respondents
CORAM:
HON'BLE MR. JUSTICE PARMOD GOYAL Present:- Mr. Rajesh Gupta, Advocate for the petitioner.
***** PARMOD GOYAL, J. (Oral) Through, the present petition, the applicant has challenged the impugned order 12.07.2025 (Annexure P-5) passed by the Election Tribunal of Bar Council of Punjab and Haryana, High Court, whereby his application for impleadment as necessary party in election petition preferred by respondent was dismissed.
Heard.
Admittedly, petitioner was elected unanimously as Secretary of Bar Association Rai, District Sonipat and election petition has been preferred only against President of Bar on the ground that he is not eligible because he has already undergone two terms of President and therefore, his nomination ought to have been rejected and were wrongly accepted. The relief sought by petitioner in election petition is against President-Sanjay Khereta alone and not against present petitioner. Learned counsel for the petitioner has tried to refer paragraphs of election petition to argue that the entire election process is being
CR-5282-2025 challenged. However, perusal of the said paragraphs referred by learned counsel clearly shows that said paragraphs are simply narration of facts and no claim against present applicant has been made. Therefore, petitioner is neither necessary party nor has any locus standi to approach Election Tribunal for his impleadment. As such, the learned Tribunal rightly recorded the fact that the effort on part of petitioner to get himself impleaded is just to delay the result of election petition.
The revision petition is totally misconceived and an effort to delay result of election petition. Same stands dismissed, accordingly, with cost of Rs. 5,000/- to be deposited by the petitioner with the Bar Association Rai, Sonipat which shall be used for the purpose of planting trees/cleanliness purposes.
