The present petition has been filed under Articles 226 and 227 of the Constitution of India for issuance of writ of mandamus against the Department for denying the petitioner benefit of premature release under Government Policy, Annexure P1.

Learned counsel submits that the petitioner fulfils the criteria and condition for premature release as contained in the said Policy dated 12.04.2002 and places reliance on Lallan @ Pankaj vs. State of Haryana and others, CRM-M-8450-2024, decided on 02.09.2024 and similar matters i.e. Shamsher vs. State of Haryana and others, CRWP-2201-2024, decided on 30.04.2024 and Raju @ Rajesh vs. State of Haryana and others, CRWP-2160-2024, stand disposed of by this Court vide orders date 30.04.2024 and 11.03.2024, Annexures P6 and P7, respectively.

Learned State counsel submits that the matter shall be reconsidered and decision thereon be taken, taking note of the aforesaid judgments, within a period of 8 weeks, uninfluenced by the impugned order dated 29.11.2003, Annexure P2, in the present case.

The aforesaid satisfies learned counsel for the petitioner. 5.

Disposed of accordingly.
