PANKAJ JAIN, J. (ORAL) This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case F.I.R. No.106 dated 24th of May, 2018 registered for the offences punishable under Sections 21 of Narcotic Drugs and Psychotropic Substance Act No.61 of 1985 (for short, 'the NDPS Act') at Police Station Kalanwali, District Sirsa (Haryana). Ld. Counsel for the petitioner submits that the petitioner is in custody since 20th of November, 2018. He submits that besides merits of the case the petitioner has a right to speedy trial and relies upon the orders passed by this Court in CRM-M No.41230 of 2022 titled as Vinod Kumar @ Gabbar vs. State of Punjab and CRM-M-29466-2022 titled as Naib Singh vs. State of Haryana, on 14th of September, 2022 and 15th of November, 2022, respectively.

CRM-M-49980-2022 -2Per Contra, State Counsel submits that the petitioner is a habitual offender having more than 4 more cases registered under the provisions of NDPS Act against him. He further submits that it is not a case wherein the trial has not progressed at all. Out of 18 cited witnesses 5 already stands examined.

Keeping in view the totality of the circumstances and the fact that the petitioner definitely has a right to speedy trial as guaranteed under Article 21 of the Constitution of India, the present petition is disposed off with a direction to the Trial Court to expedite the trial and conclude the same preferably within six months from the date of receipt of certified copy of this order.
