Prayer in the present petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita Act, 2023 is for issuance of direction to respondents No. 2 to 5 to conduct fair and impartial investigation under supervision of higher officers not below the rank of ACP in case FIR No. 75 dated 26.06.2024 under Section 308, 323, 506, IPC 1860 (Section 307 IPC added later on) registered at Police Station Bhupani District Faridabad (Haryana). 2.
Learned State counsel while placing reliance upon the status report has contended that the complainant and his brother were medico legally examined. The accused person Jai Prakash @ Vicky was arrested on 06.07.2024, who got recovered an iron pipe from his house. The accused-Devi Ram was formally arrested on 01.08.2024 and section 307 IPC was added after opinion of doctor. Ram, the challan was presented before the trial Court on 01.10.2024 and supplementary challan of Satbir and Tekchand was presented on 20-10-2024. During verification of investigation by ACP, Central, Faridabad the persons Shyambir, Nitin, Karambir, Naveen, Dharmendra and Balbir were not found involved in the present case.

It was further contended that present FIR No. 64 dated 29-05-2024 U/s 147, 148, 149, 323, 325, 506 IPC is a cross case, which was registered before the case FIR No. 75 dated 26-06-2024, wherein the accused Rohit and others are involved and accused-Rohit has not been arrested yet. The FIR No. 64 dated 29.05. ! " is pending for trial before Court of Ld. Judicial Magistrate First Class, Faridabad and the next date in the case is 03-12-2024. "
