The petitioner is aspirant for admission to MBA (EP) course under sports category for the academic session 2024-25 to be conducted by respondents No.1 and 3.

Learned counsel for the petitioner submits that the seat is still lying vacant and therefore, action of the respondents in issuing Annexure P-12 declining to accept the request of the petitioner is unjustified. The record reveals that the last date for admission after concluding the counseling(s) was 31.07.2024.

Learned counsel for the respondent-University also informs that the classes of the said course had commenced as early as on 10.07.2024. Clause X concerning the admission process as per the Prospectus Annexure P-11 clearly reveals that there will be no admissions after 31.07.2024. In view of the above, the petitioner who has approached this Court at a belated stage cannot be granted admission. Even the reliance placed by learned counsel for petitioner upon a decision of the Apex Court in S.Krishna Sradha vs. State of Andhra Pradesh and others 2020 AIR Supreme Court 47 would not help the case of the petitioner because in the said case the concerned student had approached this Court within time, hence the aforesaid judgment is not applicable to the facts of the matter at hand. 5.
Accordingly, the petition stands dismissed.
