The petitioners seek quashing of DDR No.20, dated 4.5.2023 registered at Police Station Dinanagar, District Gurdaspur, under Sections 452, 323, 324, 34 of Indian Penal Code in FIR No.0066, dated 12.4.2023 registered at Police Station Dinanagar, District Gurdaspur, under Sections 452, 326, 323, 324, 34 of Indian Penal Code and all subsequent proceedings emanating therefrom on the basis of a compromise stated to have been effected between the parties.

Vide order dated 6.10.2023, the parties had been directed to appear before the trial Court/Duty Magistrate so as to get their statements recorded qua the factum of compromise.

Report of learned Judicial Magistrate 1st Class, Gurdaspur has been received, wherein it has been reported that statements of petitioners/accused Bevi, Sunny Kumar, Daine and also statements of respondents No.2 to 4 namely Balwinder Kumar, Rajinder Kumar @ Raman, Vishu Preet have been recorded to the effect that they have compromised the matter amongst themselves.

Respondents No.2 to 4 namely Balwinder Kumar, Rajinder Kumar @ Raman, Vishu Preet in their statements have stated that they have no objection in case the DDR in question is quashed. 5.

Learned Judicial Magistrate 1st Class, Gurdaspur has specifically opined that the parties have entered into compromise voluntarily and without any undue influence.

In view of the aforesaid compromise and bearing in mind the law laid down by Full Bench of this Court in 2007(3) RCR (Crl.) 1052 Kulwinder Singh and others Vs. State of Punjab, the present petition is allowed and DDR No.20, dated 4.5.2023 registered at Police Station Dinanagar, District Gurdaspur, under Sections 452, 323, 324, 34 of Indian Penal Code in FIR No.0066, dated 12.4.2023 registered at Police Station Dinanagar, District Gurdaspur, under Sections 452, 326, 323, 324, 34 of Indian Penal Code and all subsequent proceedings emanating therefrom are hereby quashed qua petitioners.
