03%*3+-3+'3.4*3.5 Through the instant petition under Section 482 of the Code of Criminal Procedure, the petitioner is seeking direction to trial court i.e. court of Judicial Magistrate Ist Class. Phul, Bathinda to expedite the trial in case FIR No. 122 dated 29.9.2019 under Sections 324, 323, 341 and 34 of IPC, registered at Police Station Phul, District Bathinda. Learned counsel for the petitioner submits that candidature of the petitioner as Veterinary Inspector in department of Animal Husbandry has been withheld only on account of pendency of criminal case against the petitioner even though the petitioner figures in the merit list at Sr. No. 158 and there are total 866 posts.

From the perusal of zimni orders enclosed with the petition, it transpires that on a number of occasions matter was adjourned on account of non-appearance of the petitioner as well non-advancing of arguments with respect to application seeking deposit of passport of the petitioner.   The charges have been framed on 10.8.2022 and matter is fixed for prosecution evidence.

Notice of motion.

Mr. J.P.Ratra, Sr. DAG, Punjab, accepts notice and on instructions from ASI Lakhwinder Singh, submits that out of total 10 witnesses, 06 are official witnesses. He submits that the official witnesses shall remain present before the trial court on the date fixed. In view of statement of learned State counsel, the present petition is disposed of. It is made clear that the petitioner shall not seek any adjournment on any aground and trial court shall be free to impose costs if the petitioner seeks adjournment.
