***** ARCHANA PURI, J. (Oral) As observed in the previous order, despite service, the respondent did not made appearance. Even today, he has not made appearance. As such, respondent is proceeded against ex parte. Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. DMC/267/2025 titled 'Ritesh Sharma v/s Sandhya', filed by the respondenthusband, pending in the Family Court, Bhiwani and she seeks transfer of the same to the Court of competent jurisdiction at Kaithal. At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 09.12.2022 and one son was born from the said wedlock, who is about 1 1⁄2 years old, in the care and custody of the applicant. TA-995-2025 (O&M) having any source of earning and is dependent upon her parental family. Even, she has filed the petition under the Protection of Women from Domestic Violence Act, which are pending in the courts at Kaithal and the respondent is pursuing the same. The distance between the two places is stated to be about 138 kms.

In view of the aforesaid fact situation, more particularly, considering the minor child, who is a toddler, to be in the care and custody of the applicant, while she herself has no source of earning, fact of one case arising from the matrimonial dispute, already pending in the Courts at Kaithal and also considering the distance between the two places, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. DMC/267/2025 titled 'Ritesh Sharma v/s Sandhya', filed by the respondent-husband, stands transferred from the Family Court, Bhiwani, to the Court of competent jurisdiction at Kaithal. The requisite record of the aforesaid case be sent by the Family Court, Bhiwani, to the District and Sessions Judge, Kaithal.

Learned District and Sessions Judge, Kaithal, shall assign the said petition to the Family Court, Kaithal. Even, the parties are directed to appear before the Family Court, Kaithal, within a period of one month from today onwards.
