RSA No.4919 of 2016 Plaintiffs-appellants are in regular second appeal against the concurrent findings of fact arrived at by the Courts below. Plaintiffs had filed a suit for permanent injunction restraining the defendants from interfering in their easementary right of passage shown in the site plan.

This Court while deciding Regular Second Appeal No.94 of 2016, which belongs to the neighbour of the appellants on similar ground has already given a detailed judgment. It is not in dispute that the appellant has relied upon the aforesaid appeal in the present appeal.

Hence, the present appeal is dismissed for the detailed reasons recorded in the Regular Second Appeal No.94 of 2016.
