This matter is being taken up for hearing through video conferencing due to outbreak of the pandemic, COVID-19.

Petitioner claims to be entitled to receive pensionary benefits as applicable to the employees recruited prior to 01.01.2004. It is submitted that petitioner was initially appointed in the year 1990.However, his services were regularized subsequent to 01.01.2004. Learned counsel for the petitioner submits that petitioner is entitled to the relief claimed, in terms of decision/s dated 31.08.2010 in CWP-2371-2010; dated 23.01.2013 in CWP-1432-2012; dated 10.10.2014 in CWP-23606-2012, dated 14.07.2014 in CWP-3250-2014; dated 30.03.2016 in CWP-10376-2014 and 07.01.2016 in CWP-24472-2015. It is further submitted that representation dated 23.09.2021 (Annexure P22) was submitted by the petitioner but to no avail.

At this stage, learned counsel for the petitioner restricts theprayer for a decision on representation dated 23.09.2021 (Annexure P22), submitted by the petitioners, in a time bound manner.

Keeping in view the limited prayer addressed, facts and circumstances of the case but without expressing any opinion on the merits thereof, this writ petition is disposed of with a direction to the competent authority, to decide representation dated 23.09.2021 (Annexure P22) by passing a speaking order, within four months from the date of receipt of certified copy of this order.
