Dated Police Station Sections 18.03.2023 Karnal Sadar, 406, 420, 379B, 120B IPC, District Karnal Section 24 of Immigration Act and 25 of Arms Act 1.

Seeking cancellation of bail granted to the accused in the FIR captioned above, the aggrieved person has come up before this Court under Section 483(3) r/w 528 BNSS 2023.

Vide order dated 15.07.2024, the trial court had granted bail subject to the following conditions:- "(1)That Applicant/Accused shall not undertake any action which is prejudicial to the proceedings during the course of the trial.

(2) That Applicant/Accused shall attend all dates during the trial unless prevented by any reasonable cause.

(3) That Applicant/Accused neither personally nor through anyone will make any attempt to influence the witnesses or tamper with the evidence.

Complainant's counsel seeks cancellation of bail on the violation of condition No.2 mentioned above.

Accused counsel submits that absence was not intentional and it was due to the situation beyond control of the accused and now he undertakes to attend each and every date before the trial Court. Counsel further submits that the accused shall not leave the country without permission of the trial Court, during pendency of the trial. 5.

Given the above facts and circumstances, present petition is dismissed with clarification that in case accused wants to leave the country, while seeking permission to travel abroad, he shall inform the place and date of travel to the trial Court. In case of violation, the trial Court to proceed further by passing order of confiscation of the passport, asking for revocation of the visa and cancellation of bail. Pending applications if any, stand disposed of.
