(Oral) By way of present revision, challenge has been made to an order dated 22.09.2022 (Annexure P-13) passed by the court of learned Additional Civil Judge (Senior Division), Kharar, whereby the prayer made on behalf of respondent No.1-plaintiff for seeking revival of the civil suit has been allowed.

Notice of motion was issued by this Court on 31.10.2022, only for a limited purpose of calling upon respondent No.1-plaintiff to affix court fee on the plaint, which was earlier ordered to be refunded in his favour by the trial court.

Today, Mr. Rahul Arora, Advocate has appeared on behalf of respondent No.1-plaintiff and submits that though vide order dated 06.08.2019, the trial court ordered for refund of court fee in favour of respondent No.1-plaintiff, however, the same was never withdrawn by him and is lying deposited with the trial court only.
