The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to release family pension, gratuity, leave encashment, ex-gratia and all other pensionary/ retiral benefits.

The petitioner claims that she is duly wedded wife of Late Sh. Mohan Lalit, Sub Inspector who passed away on 07.12.2022 in harness. After the demise of said employee, another lady namely Jaswinder Kaur has lodged claim that she is legally wedded wife of aforesaid employee. The respondent has withheld retiral/terminal dues of the deceased employee on account of claim by two ladies. The petitioner has filed representation dated 01.05.2025 (Annexure P-1) seeking release of retiral dues. With the consent of both sides, the petition is taken up for final disposal today itself.

Mr. Aman Dhir, DAG, Punjab assures the Court that competent authority would consider and decide claim of the petitioner within two months from today.

Learned counsel for the petitioner agrees to the aforesaid arrangement.
