Prayer in the present petition under Section 439 of Code of Criminal Procedure is for grant of regular bail to the petitioner in case FIR No. 23 dated 05.04.2023 registered for the offences punishable under Sections 379-B, 34 of IPC (Section 411 of IPC added later on) at Police Station Jhandher, District Amritsar Rural. 2.

On the last date of hearing, direction was given to the learned trial Court to examine the complainant(s) and to submits its report in this regard. As per the report submitted by the learned trial Court in connected matter having CRM-M-528-2024 complainantGursewak Singh and eye-witness Nirmal singh were examined but they failed to identify the accused persons.

As per the custody certificate furnished by the State counsel, petitioner is in custody for the last more than 10 months. 4.

In the given circumstances, no useful purpose is going to be served by keeping the petitioner in custody for any longer period. 5.

In light of the above, without expressing any opinion on the Priyanka Thakur 2024.03.05 13:24 I attest to the accuracy and integrity of this document merits of the case, the present petition is allowed and the petitioner is
