Learned counsel for the applicant-appellant seeks permission to withdraw the appeal, submitting that the matter with the respondent/decreeholder has been amicably settled by paying the decretal amount. In view of submission made by learned counsel for the applicant-appellant, the application is allowed. RSA-3819-2015 The appeal is ordered to be dismissed as withdrawn. Counsel for the appellant requests for refund of the court fee. He may move application to this effect. However, the refund will be subject to the provisions of Court Fee Act.
