Mr. Abhilaksh Gaind, Advocate, for the respondent<FCI. **** This petition has been filed by the petitioner against the order dated 30.08.2022 (Annexure P-10) passed by respondent-Food Corporation of India whereby the contract of the petitioner has been terminated. Admittedly, an appeal against the said order filed by the petitioner is pending before the Appellate Authority.

Learned counsel appearing for the respondent-Food Corporation of India, on advance copy, submits that the competent authority to hear the appeal has since been constituted and is slated to take up the matter for consideration on 21.11.2022 at 4.00 P.M. He submits that the petitioner would be given an opportunity of hearing before passing any order. Likewise, learned counsel for the petitioner submits that the petitioner either himself or through his representative would appear before the Appellate Authority on the date fixed for hearing of the appeal. Learned counsel for the Corporation submits that the competent authority shall make all possible endeavour to decide the appeal on the date fixed or as expeditiously as possible. In view of the statements made by learned counsel for the parties and taking the same on record, the petition stands disposed of. However, the petitioner would also be at liberty, if so advised, to move an application before the Appellate Authority seeking stay or keeping in abeyance the order passed by the authorities.
