The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondents to re-issue them passport.

The petitioner No.1 was issued passport on 15.09.2009 which expired on 14.09.2019. The petitioner No.2 was issued passport on 11.09.2009 which expired on 10.09.2019. The petitioners applied for re-issuance of passport. An FIR No. 123 dated 23.08.2017, under Sections 323, 406 and 498-A of IPC was registered against the petitioners at Police Station, Women Police Station, Ambala, District Ambala. The petitioner No.1 has filed CRM-M-7983-2018 before this Court seeking setting aside of aforesaid FIR. This Court vide order dated 23.08.2018 has stayed the proceedings pending before trial Court.

Learned State counsel does not dispute the afore-stated factual position with respect to afore-stated FIR.

Learned counsel for the respondents-UOI submits that the passport was issued, however, it was impounded on account of afore-stated FIR. The petitioners may be directed to appear before passport authority alongwith requisite documents. The passport authority would look into grievance of the petitioners and pass an appropriate order, in accordance with law, within six weeks thereafter.

In the wake of statement of learned counsel for respondents-UOI, the petition stands disposed of with a direction to the petitioners to appear before passport authority on 28.12.2023 along with requisite documents. 6.
