(Oral) The petitioner has approached this Court seeking grant of regular bail in a case having FIR No.114 dated 22.5.2022 registered under Sections 419, 420, 511, 120-B IPC and Section 66-D IT Act (Sections 420, 511 IPC deleted later on and Section 170 IPC added later on) at Police Station City Sri Muktsar Sahib District Sri Muktsar Sahib. Ramandeep Kaur submits that the petitioner is working as a Tehsildar at Moga and he never made telephone call posing as a Judicial Magistrate and he is having no criminal history and she further made prayer that similarly situated co-accused Daljit Singh has been granted interim bail GAURAV SOROT 2022.11.04 15:48 I attest to the accuracy and authenticity of this order, judgment and documents.
( 2 ) CRM-M-50254-2022 by this Court vide order dated 18.10.2022, whose copy is furnished and the same is taken on record.
ASI Tarsem Singh has not disputed the fact that the petitioner was arrested on 30.9.2022 and at that time he was working as Tehsildar, Moga and the petitioner is having no criminal antecedents. I have considered the submissions made by the parties. As per the allegations recorded in the FIR, the petitioner himself never made any telephone call posing himself to be a judicial officer. The petitioner is in custody for the last more than 1 month and is not involved in any other case. The petitioner being a public servant, there is no apprehension that if released on bail, he will abscond. It will take time for the police to present challan.
In view of the above, no purpose is going to be served by keeping the accused behind the bars for any longer period. Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate concerned.
