This petition has been filed, inter alia, seeking a writ of certiorari quashing the appointment order dated 28.2.2022, Annexure P8, qua the private respondents, who are stated to be lower in merit or not eligible for the advertised post of PGT-Mathematics (Rest of Haryana cadre) pursuant to advertisement no.4 of 2015. 2.

Learned State counsel has filed a short reply which is taken on record. It is stated that recommendations qua the private respondents have been withdrawn by the Commission. Para 8 of the reply is as under: 8.

That it is further mention here that the respondent Commission has now withdrawn the recommendation made vide letter dated 23.2.2022 in view of the clarification order dated 9.5.2022 passed by the Hon'ble Supreme Court of India in MA No.539-569 of 2022 in Civil Appeal No.5065-5095 of 2021. In this regard the respondent Commission has duly written to the concerned department vide letter bearing memo no. Confd./13/2/2022-9CA/814 dated 20.9.2023 whereby the Commission has withdrawn the recommendation so made vide the recommendation letter dated Ashwani Kumar 2023.11.21 14:04 I attest to the accuracy and integrity of this document

CWP No.21558 of 2023 -2- 2023:PHHC:147167 23.2.2022. The copy of letter dated 20.9.2023 is annexed hereby as Annexure R-2/3.

He further contends that the consequent action to withdraw their appointments will be taken by the Department within two months. 4.

In view of the stand taken and statement made by learned State counsel, learned counsel for the petitioner has no objection to the petition being disposed of in terms thereof.
