The present appeal has been filed by the defendant-appellant against the judgment and decree dated 07.04.2016 passed by the First Appellate Court. Notice of motion in this case was issued on 03.08.2018, however, no interim relief was granted. On 06.05.2019 counsel for the appellant sought time to move an appropriate application to implead the legal representatives of the respondent. However, till date, no application has been filed. None has put in appearance on behalf of the appellant. It appears that the appellant is not interested in pursuing the present appeal. 2.

In view of the above, this Court is left with no other option but to dismiss the present appeal for non-prosecution. Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
