In the High Court of Punjab and Haryana, at Chandigarh Civil Revision No. 4953 of 2022 Date of Decision: 21.11.2022 Swaran Kaur and Others ... Petitioner(s)

Versus

Sukhwant Singh and Others ... Respondent(s) CORAM: Hon'ble Mr. Justice Anil Kshetarpal.

Present:

Mr. Kamal Narula, Advocate for the petitioner(s).

Anil Kshetarpal, J.

1.

The defendants, in a suit for grant of decree for permanent injunction, are the petitioners herein. The plaintiffs and the defendants are neighbours. In order to prove the alleged compromise/settlement, the defendants have already examined the Handwriting and Fingerprint Expert. The plaintiffs' application for permission to examine the Handwriting and Fingerprint Expert has been allowed. This revision petition has been filed by the defendants challenging the correctness of the aforesaid order. 2.

The learned counsel representing the petitioner contends that the plaintiffs have already concluded their evidence, therefore, they cannot be permitted to examine the Handwriting and Fingerprint Expert. 3.

This Court has considered the submissions of the learned counsel representing the petitioners. The plaintiffs have filed an application under Section 151 of the Code of Civil Procedure, 1908, for permission to lead additional evidence in the facts and circumstances of the case, which DEEPAK KUMAR BHARDWAJ 2022.11.29 15:22 I attest to the accuracy and integrity of this document

Civil Revision No. 4953 of 2022 was allowed. Admittedly, the petitioners have already examined the Handwriting and Fingerprint Expert in support of their evidence. 4.

Keeping in view the aforesaid facts, no ground is made out to interfere with the impugned order. Hence, the present revision petition is dismissed.
