(ORAL) This petition has been filed by the petitioner being aggrieved by a tender summary report dated 06.10.2021 (Annexure P-10) by which the respondent-authorities have disqualified it as well as another tenderer and awarded the contract to the sole tenderer i.e. respondent No. 4, who has remained in the fray.
It is informed that the petitioner has filed a representation dated 06.10.2021 (Annexure P-11) which is pending before the respondentauthorities. Mr. Deepak Balyan, learned Additional Advocate General, Haryana, on advance copy, submits that the respondent-authorities shall consider and pass a detailed order on the representation filed by the petitioner at the earliest and communicate the same to it accordingly. In view of the aforesaid statement made by learned State counsel, we do not find any reason to entertain the present petition which is accordingly disposed of. It is made clear that this Court has not expressed any opinion on the merits of the case and, therefore, the authorities would be at liberty to examine the matter keeping all facts and facets into consideration and thereafter accept or reject the same in accordance with law.
