Jaswant Singh,J.(Oral) Plaintiff/appellant is in second appeal against concurrent findings recorded by both the Courts below, whereby his suit for declaration and consequential relief to the effect that he was entitled to salary, allowance and other benefits for the period from 15.3.1995 to 16.7.2007 on account of having discharged two duties, was dismissed by the learned Civil Judge (Senior Division) Fatehabad vide judgment and decree dated 8.1.2011 and the appeal filed by him was also dismissed by learned District Judge,Fatehabad, vide judgment and decree dated 10.1.2013.

Since there is delay of 598 days in re-filing the appeal, an application seeking condonation of said delay has been filed. At the very outset, learned counsel for the plaintiff/appellant prays for permission to withdraw the present appeal unconditionally.

Allowed as prayed.

Dismissed as withdrawn.
