Prayer in the present petition was for setting aside the impugned order dated 06.09.2023, passed by the learned Additional Sessions Judge, Fast Track Special , Court, Nuh, whereby request of the petitioner for taking the sample of his blood and sending the same to other laboratory for determination of DNA with the sample of the victim was dismissed. 2.

Learned counsel for the State, on instructions from Inspector Raj Bala submits that in this case all the prosecution witnesses have been examined and the trial is also complete.

The matter was first listed on 27.09.2023. On that date, counsel for the petitioner was not present as the Lawyers were abstaining from work and the matter was adjourned for 06.11.2023. On that date again counsel for the petitioner not appeared and the matter was adjourned for 11.01.2024. On that date, the turn of the case could not come up and the same was adjourned "by order" for today.

Today, again even on 2nd call, none has appeared on behalf of the petitioner. It seems that the petitioner is not interest in pursuing the present petition.
