(ORAL) By way of this petition, the petitioner seeks the relief of regular bail in the criminal case arising out of the FIR bearing No.79 dated 10.11.2021 registered at Police Station Aur, District SBS Nagar, under Section 306 IPC, with the allegations that she, along-with her co-accused namely Sunita Devi, Boby @ Dharamvir, Saroj and Sonu @ Manpreet, abetted the husband of her said co-accused Sunita Devi named Ajay Kumar, to commit suicide.

Mr. Kirat Singh Sidhu, learned Deputy Advocate General, Punjab, has joined the proceedings in pursuance of the notice of the present petition having been sent to the respondent-State in advance. I have heard learned counsel for the petitioner as well as learned State counsel in the instant petition and have also perused the file thoroughly.

co-accused of the petitioner named Sonu @ Manpreet and Boby @ Dharamvir, who have been attributed the role similar to that of the petitioner in the alleged occurrence, have already been granted the relief of interim anticipatory bail vide the orders dated 13.12.2021 and 05.01.2022 as passed in CRM-M No.51705 of 2021 & CRM-M No.54391 of 2021, respectively and the petitioner is behind the bars since 10.11.2021 and she is also not involved in any other criminal case of the similar nature and the Challan has already been presented in the Court and in these circumstances, she (petitioner) deserves the relief as prayed for in this petition.

Learned State counsel does not dispute the above-referred factual position.

Keeping in view the afore-discussed facts and circumstances as well as the fact that the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Hardeep Kaur Wagla alias Kamla is ordered to be released on regular bail subject to her furnishing the requisite personal and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
