Petitioner has filed this petition under Section 439 Cr.P.C for grant of regular bail pending trial in case FIR No.86 dated 08.06.2019 registered under Sections 15, 25 and 29 of NDPS Act, 1985 at Police Station Dhanaula, District Barnala. The petitioner is in custody since his arrest on 08.06.2019.

The contents of the FIR as noticed by the learned Additional Sessions Judge, Barnala in order dated 24.09.2019 reads as under:- "The prosecution case is that on 08.06.2019 Sub Inspector Baljeet Singh of CIA Staff while present on patrol duty near Tandian Dhabha, received a secret information from a reliable informant on the basis of which ASI Gurcharan Singh intercepted truck no. PB 65-D 7371 and a Zen car bearing registration no. DL 03CZ-5241 in Grain market, Dhanaula and apprehended Amrik Singh, Paramjit Singh alias Pamma (applicant) Amandeep Singh, Gurjant Singh GEETA RANI 2022.03.23 10:43 I attest to the accuracy and authenticity of this document

CRM-M-43759-2019 (O&M) -2and Gobind Singh and after observing the necessary formalities as per mandate of the Act, conducted search of the truck and Zen car aforesaid in the presence of Rajesh Kumar Chhiber, Deputy Superintendent of Police, and recovered 25 bags of poppy husk from the said vehicles. Each bag containing 20 Kgs of poppy husk. The same along with vehicles were seized. Samples were drawn and sent for chemical analysis. The case was got registered for offence under sections 15, 25 and 29 of the Act." Learned State counsel assisted by ASI Hardhan Singh has pointed out that 5 quintals of poppy husk was recovered from vehicles bearing No.PB 65-D 7371 and a Zen car bearing registration No. DL 03CZ5241, while acting upon the secret information and accused persons including the petitioner was arrested on the spot. He submits that the quantity of seized contraband falls under the commercial quantity. He on instructions further states that out of total 31 prosecution witnesses, 13 witnesses have already been examined. He prays for dismissal of the petition.

After hearing the learned State counsel, considering the above background, particularly the nature and quantity of the contraband, this Court is not inclined to extend the concession of bail to the petitioner. Resultantly, without meaning any expression on the merits of this case, the petition is dismissed.
