By way of this common order both the aforementioned petitions are being disposed of.

Present petitions have been filed under Section 483 of BNSS, seeking regular bail in case FIR No. 62 dated 14.03.2025, under Sections 22C/29/61/85 of NDPS Act, registered at Police Station Phillaur.

As per the allegations in the FIR, police party noticed two women (petitioners herein), who, upon seeing the police party, started slipping away from the road. In the left hand of Kulwinder Kaur, a polythene envelope was noticed, and upon conducting a search, 65 tablets of Etizolam were recovered therefrom.  earlier been observed being handed over by Amandeep Kaur to Kulwinder Kaur.

Learned State counsel has filed the custody certificates of the petitioners in Court today. Same are taken on record. Registry is directed to tag the same at the appropriate place in the paper book. 5.

While referring to the custody certificates, learned State counsel submits that petitioners are in custody since 14.03.2025. However, in another case involving possession of a noncommercial quantity, petitionerAmandeep Kaur was convicted and sentenced; she has, however, been released on bail upon filing an appeal before this Court.

PetitionerKulwinder Kaur is facing two other cases under the provisions of the NDPS Act.

Faced with this situation, learned counsel for the petitioners submit that they may be permitted to withdraw the present petitions at this stage, with liberty to file fresh petitions at the appropriate stage. 7.

In view of the above, present petitions are disposed of as withdrawn. However, petitioners may choose to file fresh petition seeking bail after a period of six months, if the trial is not concluded. 8.

A photocopy of this order be placed on the file of another connected case.
