*** HARSIMRAN SINGH SETHI , J. (ORAL) The grievance raised in the present writ petition is that husband of the petitioner, namely, Sh. Rajinder Kumar, who was working as a Clerk with respondent No.4 -Nagar Council, Guruharshai, District Ferozepur, unfortunately died while in service on 08.07.2018, but no benefit in respect of the service, which late husband of the petitioner had rendered with the respondent No.4, has been released to the petitioner despite the fact that more than one year has elapsed since the death of husband of the petitioner in July, 2018.
Counsel for the petitioner states that only a sum of `1 lakh was released to the petitioner and that too without giving any detail, whereas, about `12 lakhs is still due to be paid to the petitioner in respect of the service rendered by late husband of the petitioner. CWP-29432-2019 -2respondents to withhold the said amount and therefore, a direction be issued to the respondents to release all the benefits for which the petitioner is entitled for in respect of the service rendered by her husband as well as the family pension alongwith arrears from the date of death of husband of the petitioner.
Counsel for the petitioner states that for the relief which has been sought in the present writ petition, petitioner has submitted the representations dated 20.02.2019 and 07.03.2019 (Annexure P-2 Colly.), which are still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said representations. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the representations dated 20.02.2019 and 07.03.2019 (Annexure P-2 Colly.) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to her within a period of three months thereafter.
Present writ petition stands disposed of.
