DEEPAK GUPTA , J.(Oral) Prayer in this petition under Section 438 Cr.P.C. is for grant of anticipatory bail in case FIR No.282, dated 08.08.2023, under Sections 22 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act'), registered at Police Station City Hoshiarpur, District Hoshiarpur.

As per prosecution allegations 160 grams of intoxicant powder was recovered from co-accused Jaswinder Kumar @ Jassi on 08.08.2023 and on interrogation of said Jaswinder Kumar @ Jassi, he nominated the petitioner to be supplier.

It is contended by learned counsel for petitioner that no recovery was effected from the petitioner; that petitioner was not arrested from the spot; that Jaswinder Kumar @ Jassi from whom recovery was effected, has already been allowed interim bail vide order dated 14.09.2023 (Annexure P-1) Notice of motion.

Mr. M.S. Nagra, AAG, Punjab accepts notice on behalf of respondent-State.

CRM-M-48530-2023 - 2 - Learned State counsel has pointed out towards para No.16 of the petition, revealing that petitioner is involved in two more cases pertaining to NDPS Act.

Having regard to the criminal antecedent of the petitioner, his custodial interrogation is required to know the origin of the contraband. No case for anticipatory bail is made out.

Dismissed.
