By way of filing the present contempt petition, the petitioners have alleged intentional and willfull disobedience of the order dated 05.03.2024, by the respondents, whereby, the following order was passed:- "xxxxxx Learned counsel for the petitioners contends that the issue raised in the petition stands decided in petitioners' favour vide judgment dated 30.01.2024 rendered by this Court in Civil Writ Petition No.20891 of 2018, titled Surajbir Rathee and others vs. State of Haryana and others. Therefore, the instant petition may also be disposed of directing the respondents to take a decision regarding petitioner's claim in the light of this judgment.

Compliance report dated 09.10.2024, filed by way of an affidavit of Dr. Sumita Misra, IAS, Additional Chief Secretary to Government of Haryana, Medical Education and Research Department, Chandigarh, on behalf of respondent No.1, is taken on record. 2.1 Learned counsel for the respondents submits that in compliance of the order dated 05.03.2024, the case of the petitioners has been considered and a Speaking Order dated 01.10.2024 has been passed by the Director, B.D. Sharma, Post Graudate Institute of Medical Sciences, Rohtak (Annexure R-1/1).

Learned counsel for the petitioners submits that the case of the petitioners has been wrongly declined by the respondents by passing the aforesaid order. He submits that the present petition may be disposed of with liberty to the petitioners to avail alternate remedy to challenge the said action of the respondents.

In view of the above, the present contempt petition stands disposed of with liberty to the petitioners to avail alternate remedy, as per law.

Pending miscellaneous applications, if any, shall stand disposed of.
