An identical appeal on the similar grounds was filed by the appellant in RSA No.3996 of 2016 which was dismissed on 20.10.2016 on account of delay as well as on merits.

Since the controversy involved in the present appeal is same as was addressed in the aforementioned second appeal, the present appeal is also dismissed on account of delay as well as on merits, in view of the decision taken in RSA No.3996 of 2016.
