(ORAL) Prayer in this petition is for quashing of the order dated 20.08.2022 passed by the trial Court, vide which the petitioner has been declared as proclaimed offender in complaint No.NACT/178/2018 dated 02.07.2018. While issuing notice of motion, following order was passed by this Court on 23.11.2022: - "Learned counsel for the petitioner submits that the petitioner was granted the concession of regular bail and was regularly attending the court proceedings, however, he could not appear before the trial Court on 25.04.2022 on account of noting down a wrong date and thereafter, his bail/surety bonds were cancelled and he was VISHNU 2022.12.08 16:37 I attest to the accuracy and integrity of this document Punjab and Haryana High Court, Chandigarh

Learned counsel further submits that the petitioner is ready to surrender before the trial Court and apply for grant of fresh bail.

Notice of motion for 08.12.2022.

In the meantime, the petitioner is directed to appear before the trial Court within a period of 10 days from today and on doing so, the trial Court will release him on interim bail, subject to his furnishing fresh bail/surety bonds to its satisfaction. Till the time the petitioner appears before the trial Court, his arrest shall remain stayed."

Learned counsel for the petitioner submits that in pursuance of the aforesaid order, the petitioner has appeared before the trial Court and he has been released on interim bail.

Learned State counsel has not disputed the aforesaid fact. In view of the above, this petition is allowed. The order dated 23.11.2022, granting interim bail to the petitioner, is made absolute and the impugned order dated 20.08.2022, declaring him proclaimed offender, is set aside.
